The goal of any good trademark is its ability to distinguish the source of your goods or services from those of your competitors. When choosing a trademark it is important to balance marketing considerations and legal considerations.<\/p>\n<p>From a marketing perspective, you want your trademarks to be synonymous with your business, and vice versa. It will be straight-forward, to the point, and will identify the goods or services being offered. It will be easy to understand and will require little advertising to promote your goods or services. For example: if you use \u201cThe Craft Store\u201d for craft supplies, customers will, without question, know where to go to get their craft supplies.<\/p>\n<p>However, being straight-forward, to the point and descriptive of the goods or services being offered will not make for a legally enforceable trademark. If your trademark cannot be enforced against others, you cannot protect it and it will not hold much in the way of value. A trademark that simply describes the goods or services with which it is associated is descriptive and unregistrable unless it has become distinctive through use over time. \u201cDistinctive\u201d means that it has become known in the marketplace to the point that customers associate this descriptive trademark with your business\u2019 goods or services. \u201cThe Beer Store\u201d is such an example.<\/p>\n<p><strong>So what kind of trademark should you choose?<\/strong><\/p>\n<h2>Fanciful Trademarks<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-1418\" src=\"https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/kodak-300x274.png\" alt=\"Fanciful Trademarks\" width=\"176\" height=\"160\" srcset=\"https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/kodak-300x274.png 300w, https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/kodak-768x702.png 768w, https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/kodak-610x558.png 610w, https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/kodak.png 1000w\" sizes=\"auto, (max-width: 176px) 100vw, 176px\" \/>The strongest trademarks are those that are non-descriptive and have nothing to do with the goods or services being offered. Coined terms work very well. No other business in your industry will lay claim to these words because they have no meaning outside of their use as your trademark.<\/p>\n<p>\u201cKODAK\u201d for cameras is an example.<\/p>\n<h2><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1416\" src=\"https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/Apple_logo-300x227.png\" alt=\"Arbitrary Trademarks\" width=\"200\" height=\"151\" srcset=\"https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/Apple_logo-300x227.png 300w, https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/Apple_logo-768x581.png 768w, https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/Apple_logo-610x461.png 610w, https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/Apple_logo-510x382.png 510w, https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/Apple_logo.png 1000w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/>Arbitrary Trademarks<\/h2>\n<p>Arbitrary marks are another form of strong trademark. Arbitrary marks are words that are not coined terms, but still have nothing to do with the goods or services being provided.<\/p>\n<p>\u201cAPPLE\u201d for computers, for example.<\/p>\n<h2>Suggestive Trademarks<\/h2>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-1421\" src=\"https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/Sandals.png\" alt=\"Suggestive Trademarks\" width=\"165\" height=\"165\" srcset=\"https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/Sandals.png 180w, https:\/\/www.innovators.org\/stage\/wp-content\/uploads\/2017\/03\/Sandals-150x150.png 150w\" sizes=\"auto, (max-width: 165px) 100vw, 165px\" \/>These trademarks allude to what your business is offering to the customer, without being explicit. More creativity is required to ensure that these trademarks suggest what is being offered without describing it.<\/p>\n<p>\u201cSANDALS\u201d for a beach resort or \u201cTHE BARN\u201d for a grocery store are good examples.<\/p>\n<p>Being creative with your trademarks will help to ensure that they are distinct \u2013 both from the trademarks of others and from the terms used to describe the goods and services in question. Try altering the word of the product you are selling. Apple has had much success selling its \u201ciPhone\u201d in this way. You can also try pairing words that are not typically seen together. \u201cFacebook\u201d is much more registrable than \u201cOnline Scrapbook\u201d might have been. Finally, try inventing new words by combining elements of existing words.
